Prosectors File to Block Sowell Retrial

Prosecutors for Cuyahoga County filed a motion Friday to block a retrial of Anthony Sowell. Defense attorneys claim juror misconduct.

They are specifically referring to comments about by the jury foreman that Sowell winked to her during the trial.

Prosecutors say the motion is without merit because the foreman stated she followed the law during the trial and deliberations, and was not affected by any personal feelings for Sowell.

I can only assume that this motion was made pre-emptively, as the defense motion is already invalid. According to Ohio law, the defense must wait two weeks after sentencing to request a new trial.

They barely waited two hours, although they have indicated they intend to refile their motion.
